When Estate Planning documents are drafted, they must be properly executed or signed. A Notary can Notarize signatures (stating that the person before them signing has provided proof of who they say they are), and witnesses are needed to attest that the person having the documents drafted and signing, was observed signing the documents in their presence, and appears to be of sound mind and over 18 years old. Many institutions, banks and Credit Unions will not Notarize any document requiring a statement of "sound mind" or "capacity" of the signer.
