Estate Planning- Trusts, Wills, and Probate Avoidance

Estate Planning can be as complex or simplistic as the circumstances direct.  It isn't necessarily the value of the things a person has in their Estate, that creates complexity, but rather, how they need to leave assets.  We are on the threshold of the biggest wealth reception trend in the history of the U.S., because the largest demographic of "Savers and Investors" are aging and passing wealth to generations who have not experienced the same circumstances and hardships that the Savers and Investors have experienced.  We explore values and strategies to assist "Receivers" so that what they receive has the strongest benefit for them and the generations after them.  Creating "Lottery Winners" who end up broke or poverty stricken after a short spending spree is not generally what the Saving and Investing generation worked so hard to achieve.  Take time to receive good counsel on the powerful tools available to secure a loving legacy.  Counseling Appointments are available for all types of Savers and Receivers.  Please call to schedule an appointment at (520) 720-0836.

Assistance Documents- Powers of Attorney

Why do people need a Financial Power of Attorney?

Each adult has the right to determine how to spend their money, invest, buy and sell assets, enter contracts, defend or initiate legal action, open and close accounts, borrow and save money, and so much more.  In order to do these things, a person signs their name on documents or clicks an acceptance box.  Some time in life, you will need someone to help with finances due to your unavailability, inability, incapacity, or by personal preference.  In order to receive help with finances, the person must grant authority to another, in writing, so that the power is legally transferred, for either a specific time period, specific purpose, or for long term. The power can become effective immediately or upon incapacity, and is revocable by the person granting power so long as they are not legally incapacitated or unable to make reasoned decisions in their own best interest.  A decision to grant power to another should be contemplated and executed as an informed decision, with guidance from trusted advisors, before the need arises, when you can be confident in your choices and are less pressured by difficult circumstances.  If we could see the future, most of us would prepare much more diligently, so without that vision of knowing, it is much more crucial to plan well and thoroughly. Why do people need Health Care Power of Attorney  documents?

Just like in finances, each adult has the right to determine how they wish to receive medical treatment or to object to having treatment.  Needing help with those decisions can arise from very simple circumstances like when you are recovering from surgery and need a prescription or to have someone ask the doctor questions for you outside of your presence, to the more crucial situations of being unconscious or incapable of conveying decisions that are in your best interest medically.  Because medical information is protected under the Health Insurance Portability and Accountability Act (“HIPAA”), it is unlawful for medical professionals to share a patient's medical information without present verbal consent or signed authorization.  That is why having an "agent" designated in writing, who knows you and understands medical preferences, that you have discussed with them, or have detailed in your Power of Attorney, is critical, in case you are unable to speak for yourself.  A Living Will  is often attached to the Health Care Power of Attorney to direct medical interventions in the last stages of life, when death is imminent and medically certain. 

Arizona also has a Mental Health Care Power of Attorney  for specific mental health facility and treatment decisions as well.  This document is important with the rise in Alzheimer, dementia, alcohol and drug addiction, and mental health crisis.  Discussing all of these types of issues are best handled before diagnosis or crisis when a person's mind is more clear, and not under distress.  We value helping to guide you through the contemplation needed and can document your decisions.

Whether young or matured, we all need our voice heard when we can't speak for ourselves.  Having the correct documents in place, paired with good counseling and helpers, can bring peace in the midst of difficulty, if it arises.

What happens if parents are unable to care for their children because of health issues or death?  Setting up a solid plan for Guardianship and a Conservator is a proactive strategy.
